Welcome! By using Buy4.com, you agree to be bound by the following terms and conditions (the "Terms of Service").
Buy4.com Overview
These Terms of Service sets forth the standards for using all Buy4.com Sites. For the purposes of this policy, "Site" and "Sites" refers collectively to all Buy4.com websites. "Cause" refers to any organization to which donations can be made through the Site. "Affiliated Cause" refers to organizations that have requested and received co-branded marketplaces from Buy4.com, and "we" refers to Buy4.com.
By using the Site, Users agree to these Terms of Service. We reserve the right, at any time, to modify, alter, or update the terms and conditions in these Terms of Service. Modifications shall become effective immediately upon posting on the Site. Your continued use of the Site after amendments are posted constitutes an acknowledgement and acceptance of the Terms of Service as modified.
Site Visitors
Purchases and Donations
Buy4.com allows nonprofits, schools, and associations (Causes) to receive donations when their supporters shop online. In order for a portion of the purchase to be donated, the User must click through an appropriate page on the Buy4.com Site or through a Buy4.com Plug-In to be redirected to the merchant's site, where a qualifying purchase must be made.
User Registration
Buy4.com believes that using our Site should be easy. Registration is strictly optional, but if selected by a User, allows for enhanced features, including:
- Tracking your contributions. (Please note: As Amazon.com only provides us with aggregate information for each Cause, we're unable to include Amazon.com purchases in your transaction history.)
- Storing preferences, such as the Cause you are shopping for, so they don't need to be reset if you happen to clear your browser cookies or access the Site from another computer.
- Receiving optional emails alerting you to opportunities for exceptionally high donations and special discounts offered to Buy4 users.
Buy4.com collects limited amounts of information on our registered users. To learn what information we collect and how we use it, please read our privacy policy
Use of This Site by Children
The Site is intended for the use of adults. If we find that children under the age of 13 have submitted any personal information as a result of a registration, such information shall be disregarded and deleted. If you know of any information submitted by children, please
contact us.
Third Party Sites
The Site contains links to other websites that are not owned or controlled by Buy4.com - most commonly links to Merchants and Causes. Please be aware that we are not responsible for the content or practices of such websites. In particular, all problems with a merchant - including billing, purchase, and delivery - should be addressed directly with the merchant. Similarly, a link to a Cause is in no way an endorsement of that cause by Buy4.com.
Payment & Transactions
Tracking Your Transactions
Registered users can view their transactions in the
Your Account
section of the Site to keep track of donations and to ensure that merchants have properly reported purchases to Buy4.com. (Please note: Amazon.com's reporting does not allow for user-level tracking, and therefore any Amazon purchases will not be reflected in the Your Account section.)
Transactions typically post within three business days of payment, though some merchants take longer. If you are a Registered User and notice a missing or inaccurate transaction that is not corrected within 15 business day after your payment has be processed, please contact us. We will contact the merchant and try to resolve the issue. (See Payment Exceptions, below, for details on transactions that may not show up in Your Account.) Please remember, Amazon.com purchases will not show up under Your Account.
When contacting us to resolve a transaction error, please include the information found on your receipt, including the name of the merchant, purchase date, order number, items purchased, total price, and your contact information as you provided it to the merchant (name, address, phone number, and email address). Please do not include a credit card number.
Payments to Causes
Buy4.com pays Causes by check quarterly. Payments are made approximately 90 days after a transaction occurs. This period allows merchants to credit returns and pay Buy4.com. A $20 minimum balance is required for payment to a Cause. Smaller balances will accrue until the next quarter.
Commissions and Donations
When users make a purchase after clicking through a Site, we receive an affiliate-marketing commission from the merchant or its agent. The Cause receives a majority of that commission as a donation. As we do not charge Causes to participate or Users to use our site, the remainder goes to Buy4.com, allowing us to continue to offer our services and helping you help the Causes you believe in.
Donation percentages listed on the site represent the amount that goes to the Cause (not the full commission amount). Buy4.com makes every effort to ensure the accuracy of these numbers. As merchants do change their commission frequently and often vary them by product or service, actual commissions and resulting donations may vary. Buy4.com has no control over merchant policies and is not responsible for variances in donations.
Donations are made by the member, not Buy4. Buy4 has a fiduciary responsibility to pay commissions to each chosen cause as directed by the member. At any time, a member may elect to keep commissions instead of donating them, if they have not yet been credited to a cause's account. Since goods are being received in exchange for monies paid, donations are likely not tax-deductable. Members should discuss this with their accountant.
Payment Exceptions
Under certain limited circumstances beyond our control, Buy4.com may be unable to complete payments to Causes.
- Organizations do not provide us with Tax ID numbers. We are required by law to obtain a Tax ID and report donations to the IRS. If after a good-faith effort Buy4.com is unable to obtain a Tax ID number from the intended recipient, we reserve the right to redistribute funds to other Causes in our system at our discretion.
- Merchants and their affiliates fail to report a transaction to us. For privacy reasons, we do not have access to any activities you engage in once you leave a Buy4.com Site for a merchant. When you click through a Buy4.com Site or use one of our Plug-Ins, the merchant you visit receives an ID number. When we get a report from that merchant or their agent, that ID number allows us to match the transaction to the intended Cause. If, for any reason, the merchant or its agent fails to report the transaction, we will not have information to make a payment. If notified of a missing transaction, Buy4.com will make every effort to work with the merchant to reconcile the issue, but the final decision with regards to payment is that of the Merchant. If you notice a missing transaction, please contact us.
- Merchants cannot verify a commissionable transaction. There are a multitude of reasons that a Merchant may be unable to verify a transaction, including but not limited to technological infrastructure of the merchant tracking systems, browser settings, corporate firewall settings, and interactions between anti-cookie software a user may have installed. It is the merchant's final decision as to whether to provide commissionable credit for a transaction.
- Merchants reverse a transaction. Merchants sometimes reverse a transaction, usually because a purchased item has been returned. If a transaction is reversed, Buy4.com does not receive a commission and is unable to make a payment to the Cause.
- Proper tracking information is not available. If after a good-faith effort Buy4.com is unable to determine the cause for which a donation was intended, Buy4.com reserves the right to redistribute funds to other Causes in our system at our discretion.
- Merchants fail to pay commissions. If, for any reason, a merchant (or its agent) fails to pay a commission, Buy4.com reserves the right not to pay out the donation.
- A User added a Cause that is not accepted by Buy4.com. For the protection of our Users, we review all organizations to ensure they meet the Eligibility requirements below. If the Cause is not approved, Buy4.com reserves the right to redistribute funds raised for it to other Causes in our system at our discretion.
Causes
Eligibility
Buy4.com works with a wide variety of Causes, including charities, educational institutions, associations, faith-based organizations, houses of worship, humanitarian groups, health organizations, advocacy groups, and many others. We take great pride in providing organizations with the internet technology and services to help them raise money and strengthen constituent relationships.
Buy4.com is non-partisan and does not take a position on its clients' missions, beliefs, or advocacy objectives.
We seek to work with organizations that share our commitment to equal opportunity and nondiscrimination. Buy4.com will not work with groups that promote violence, hatred, discrimination, or racial or religious intolerance. Buy4.com will exercise its judgment in determining whether an organization violates the spirit of these principles.
Causes must be nonprofits, schools, and associations incorporated in the United States or Canada. (Nonprofit status is not required.)
In addition, the use of Buy4.com products or services for illegal purposes or in connection with activities that the company determines to be harmful to its reputation may be grounds for us to terminate our relationship with a Cause.
Buy4 Charitable Auction Venue
Eligibility
This venue is available only to, and may only be used by individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to children (persons under the age of 18). If you are a under the age of 18, you can use this service only in conjunction with, and under the supervision of your parents or guardians. If you do not qualify, please do not use our Site. Further, your Buy4 account may not be transferred or sold to another party. If you are registering as a business entity, you represent that you have the authority to bind the entity to this Agreement.
Venue
Buy4 is not a traditional "auctioneer." Instead, the Site acts as a venue to allow charities to offer and sell items during their "set auction dates", in a variety of pricing formats, including a fixed price format and an auction-style format commonly referred to as "online auctions" or "auctions." We have no control over the quality, safety or legality of the items advertised, the truth or accuracy of the listings, or the ability of sellers to sell items.
Bidding and Buying
As a buyer, you are obligated to complete the transaction with the seller:
- If you purchase an item through a fixed price formats; or
- If you are the highest bidder at the end of an auction (meeting the applicable minimum bid or reserve requirements) and your bid is accepted by the seller, unless the item is listed in a category under the Non-Binding Bid Policy or the transaction is prohibited by law or by this Agreement.
Condition of Sales
By bidding on an item you agree to be bound by the conditions of sale included in the item's description so long as those conditions of sale are not in violation of this Agreement or unlawful. Sellers reserve the right to edit or make changes to a lot's Description or Terms. Bids are not retractable except in exceptional circumstances, such as: when the seller materially changes the item's description or terms after you bid or a clear typographical error is made.
Risk of Loss
When the Seller delivers the lot to the shipper for shipment to the Buyer, title to the lot and risk of loss will pass to the Buyer. If the lot is damaged in transit, the Buyer should contact the shipping agent and process a claim under the applicable insurance policy. A Seller is not obligated to take a lot back under the Conditions of Sale if the lot was damaged in transit (although Sellers are obligated to insure all items during transit and to provide reasonable assistance to help the Buyer resolve damage claims with the insurer.)
Withdrawing Lots
The Site Provider reserves the right to withdraw any property before the end of the sale period, halt any sale during its progress, and/or remove, screen or edit any materials or content on the Site. The Site Provider may refuse to process a transaction for any reason or refuse service to anyone at any time in its sole discretion. Neither the Site Provider nor any of its affiliates will be liable to any Buyer, Seller or third party by reason of the Site Provider's withdrawal of any property prior to the end of the sale period; halting any auction or sale during its progress; removing, screening or editing any materials or content on the Site; refusing to process a transaction; or unwinding or suspending any transaction after processing has begun. In the event of failure of Buyer to complete a sale for any reason, including the Site Provider's decision to refuse to process the transaction, the Site Provider shall have the right to sell the property to the next highest bidder. In the event of similar bids, the earliest bidder at that level will be the successful Buyer. In all cases, Site Provider's determination of the successful Buyer will be final.
Reserve Prices
All lots offered on this Site are offered subject to a reserve, which is the confidential minimum price established by the Seller below which such lot will not be sold. The Seller is not obligated to sell a lot unless the reserve price is met. A lot will be withdrawn from sale if no bid or offer equal to or above the confidential reserve for that lot is received during the sale period. The Site Provider shall have the right to complete any transaction in accordance with these provisions so long as the sale price exceeds the reserve.
Closing Times
All closing times are decided by the SELLER using Buy4's venue. Closing times are subject to change and may be changed at any time for any reason by the by the SELLER.
Warranty
Though we make every effort to ensure that this site works perfectly at all times and all transactions are properly credited, there is always a possibility that a transaction will be missing or inaccurate due to technological issues or errors on the part of the User, Merchant, or Buy4.com. When notified, we will make every reasonable effort to correct inaccuracies, but Buy4.com is in no-way liable for any such errors.
Buy4.com provides the Site and on an "as is" basis. To the fullest extent permitted by applicable law, Buy4.com makes no representations or warranties of any kind, express or implied, regarding the use of or the results from the site, in terms of the correctness, accuracy, reliability of any information contained therein, or otherwise. Buy4.com shall have no liability for any interruptions in the use of this site or the service. Buy4.com disclaims all warranties with regard to the site, the service and any related information provided, including the implied warranties of merchantability and fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties; therefore, the above provisions shall be limited to the minimum degree necessary to be legal in such jurisdictions.
